(Jean) Gagnon), and real estate property address 52 NATICOOK RD, MERRIMACK, NH 03054 FOR JUDICIAL REVIEW OF THE ABOVED REFERENCED SEALED CASE NUMBERS IN THE YEAR 2011
The Petitioners, “Karen J. Gagnon or Karen Gagnon and Michael J. Gagnon or Michael Gagnon, individually and a married couple and P/N/F for minor child, Adam M. Gagnon, and Real Estate Property 52 Naticook Rd., Merrimack, NH 03054, USA”, request that the court and honorable judge(s) assigned to the sealed dockets above provide information and where warranted, provide public access to the Petitioners, so that the Petitioners can determine prejudicial outcomes as to the contents and/or disposition of these dockets for proper appeal rights, without prior notice to the Petitioners.
A. The Petitioners, Karen J. Gagnon, and Michael J. Gagnon of 52 Naticook Rd., Merrimack, NH 03054 on information and belief that many, if not all, of the above sealed court cases in the year 2011, including the open/pending case file 226-2011-CV-00564 relates to the Petitioner(s), Karen J. Gagnon, and/or her spouse, Michael J. Gagnon, and/or their real estate property at 52 Naticook Rd., Merrimack, NH 03054 arising out of a house fire dated, October 24, 2009, still not in or occupied. Petitioners Michael J. Gagnon and Karen J. Gagnon have been married since August 14, 1999 and have never been separated and birthed minor child, Adam M. Gagnon or Adam Gagnon, date of birth, May 8, 2000. Karen Gagnon divorced her first husband, Kevin Lemieux OR Kevin L. Lemieux on September 15, 1998, Hillsborough Superior Court Docket 226-1996-M-1193. Two children were born to Kevin L. Lemieux and Karen J. Gagnon (Lemieux, Hartley), Andrew C. Lemieux or Andrew Lemieux (d.o.b. June 25, 1988), and Kayleigh J. Lemieux or Kayleigh Lemieux (d.o.b. June 23, 1987).
B. The Petitioner and only Policyholder with State Farm Mutual Automobile Insurance Company and its subsidiary State Farm Fire & Casualty Company, 1 State Farm Dr., Bloomington, Ill is Karen Gagnon. Karen Gagnon’s full legal name is Karen (first) Jean (middle) Gagnon (last) with a birth date of June 10, 1968, is currently on disability due to the continued distress of the non-response from State Farm and various state and local agencies, including but not limited to the Town of Merrimack, Fire Department, Code Enforcement, Mr. Fred Kelley, State of New Hampshire Insurance Department, Mr. Richard McCaffrey, Mr. Roger Sevigny, Ms. Catherine Drew, and the New Hampshire Attorney General’s Office, Mr. Michael DeLaney, Ms. Sarah Blodgett, Mr. Todd Flanagan with a formal complaint filed by the Petitioners of unlicensed, unsigned, unsealed report by Mr. Edgar Eslinger and Ms. Sarah Giliewicz that continues to be sitting in the New Hampshire Attorney General’s office since August 2010 or two years regarding the house fire damage at 52 Naticook Rd., Merrimack, NH 03054 and provided to Attorney Arthur O. Gormley, III by Attorney, Dennis T. Ducharme.
C. The Petitioner, Karen J. Gagnon, is the only policyholder with State Farm Mutual Automobile Insurance Company, Inc. and its subsidiary State Farm Fire and Casualty Company, of Bloomington, Illinois under Replacement policy 29-BQ3148-5, under claim Number: 29-J035-104 with coverage of $212,000 – $258,000 with code upgrades and various other policy dollars for landscpaing, driveway and other unattached property for the date of house fire loss, October 24, 2009 which provides up to two years of Additional Living Expenses, and replacement of personal property of $159,675 (“State Farm”). This binder of home replacement policy was approved by Wells Fargo in the closing, at Sweeney & Sweeney, of real estate property 52 Naticook Rd., Merrimack, NH 03054 purchased July 1, 2005 by the married couple, Michael J. Gagnon and Karen J. Gagnon as registered in the New Hampshire Registry of Deeds, Book 7494 and Page 2273 from the married couple Stanley Reed and Tee Sang Reed formerly of 107 Naticook Rd., Merrimack, NH 03054. There still exists today an illegal lien filed by Attorney F.B. Faulkner on behalf of Bergeron Construction Company, Inc., 27 Matthews, Keene, NH or Bergeron or Bergeron Construction or Bergeron Construction Co., Inc. the New Hampshire Registry of Deeds Book 8183 and Page 0817 on real estate property 52 Naticook Rd., Merrimack, NH 03054, Town of Merrimack, NH parcel 3C-66.
D. Mr. Daniel R. Bantham or Dan Bantham, 289 Daniel Webster Highway, Merrimack, NH 03054 was the Petitioner, Karen J. Gagnon’s Producer and Agent representing State Farm as of the date of loss, October 24, 2009. Dan Bantham is the Producer and Agent representing State Farm for Real Estate Property, 52 Naticook Rd., Merrimack, NH 03054.
E. Mr. Dennis T. Ducharme or Dennis Ducharme, Esquire, (Wiggin & Nourie), 25 Market St., Manchester, NH is/has been representing State Farm with and illegal entity named “Karen and Michael Gagnon” along with many related attorneys, Derek D. Lick or Derek Lick, Esquire, Sulloway & Hollis, Concord, NH, Todd J. Hathaway or Todd Hathaway, Esquire, Wadleigh, Starr & Peters, PLLC, Stephen L. Boyd or Stephen Boyd, Wadleigh, Starr & Peters, PLLC, Mr. Bertrand A. Zalinsky or Bertrand Zalinsky, Esquire, Cronin & Bisson, Manchester, NH. Mr. Dennis T. Ducharme or Dennis Ducharme, Esquire trespassed on the property of 52 Naticook Rd., Merrimack, NH 03054 for alternative means and personal gain for Wiggin & Nourie utilizing a Motion to the court with a Docket Number 10-C-440 that can be found in the fraudulent and void 10-C-446 docket. Mr. Dennis T. Ducharme, Esquire is not authorized nor does he have formal documentation to represent anything to do with real property at 52 Naticook Rd., Merrimack, NH 03054.
F. There are conflicts of interest, obstruction of justice with various expert witnesses or witnesses and document(s) such as Bonalyn J. Hartley and Clement G. A. Hartley of 16 Sandpiper Lane, Merrimack, NH 03054, Mr. Dennis P. Stavrou or Dennis Stavrou, d/b/a Paas Property Adjuster Associates, Hooksette, NH or d/b/a Property Adjuster Associates, Hooksette, NH, 33 Whitehall Terrace, Hooksette, NH, Mr. Jack L. Slatoff or Jack Slatoff, PHD of Foundation Internal Medicine, 29 Northwest Boulevard, Nashua, NH, Ms. Bethel Gilbert or Bethel Gilbert, Boundaries Therapy, 518 Great Rd., in Acton, MA.
G. Mr. Arthur Gormely, III or Terry Gormley or Arthur Gormley, Esquire of Nashua, NH and Mr. William E. Aivalikles or William Aivalikles or Bill Aivalikles, Main St, Nashua, NH 03060, Mr. Dennis P. Stavrou or Dennis Stavrou, and Ms. Bonalyn J. Hartley, POA or Bonnie Hartley or Bonalyn Hartley have intentionally misrepresented their client, Karen J. Gagnon, as she is the only policyholder with State Farm and each individually or collectively prejudiced Karen Gagnon’s spouse, Michael J. Gagnon or Michael Gagnon (See Exhibit A, January 10, 2011 and April 13, 2011 Affidavit from Michael J. Gagnon, 52 Naticook Rd., NH 03054). Also, each is void due to illegal or non-existent contracts along with their intentional misrepresentation and are and were voided by Karen J. Gagnon as Ms. Bethel Gilbert states in her January 24, 2011 letter to honorable Justice Diane Nicolosi that Karen Gagnon is under continued duress as she manages the settlement of her house fire claim (See Exhibit B, January 24, 2011).
H. Therefore, there can be no valid representation for Karen J. Gagnon as it relates to her house fire loss, dated October 24, 2009 as the house fire claim is in contention with State Farm and Karen J. Gagnon evoked the Appraisal Process with State Farm within the contractual terms of the replacement policy. State Farm and all State Agencies continue to remain silent and non-responsive to requests for a detailed list of checks with an accompanying appraisal for each check cut for real estate property 52 Naticook Rd., Merrimack, NH 03054.
I). The Petitioners assert that such a request is justified on the following grounds:
1.) In New Hampshire, “Special Matters Confidential” (“SMC”) appeared on the SMC
docket public ” kept cases involving the conduct and discipline of judges and attorneys off the
public docket. From its inception by the clerk of court in 1985 The First Amendment argument
for access to secret dockets or notices posted in the courthouse.
2.) The beneficial purpose is also evident. By examining the docket, the public can learn
about the status of a particular case and can be alerted to when particular hearings, arguments
and events will occur.
3.) According to the Hillsborough Superior Court Clerk, Marshall Buttrick, the above
cases have been sealed by agreement of the parties. In cases, where Petitioner(s), is/are being
prejudiced by orders, open/pending cases, and disposition of cases/dockets where the Petitioners,
did not have the opportunity to speak for her/himself/itself, have access or knowledge
about the proceedings that may affect ability to recover with State Farm or other possible
Defendant’s, or intervene with documents contrary to these outcomes is prejudical to Petitioners,
Karen J. Gagnon or Karen Gagnon, 52 Naticook Rd., Merrimack, NH 03054 as the policyholder with State
Farm for date of loss, October 24, 2009, Michael J. Gagnon or Michael Gagnon, homeowner/deedholder
for 52 Naticook Rd., Merrimack, NH 03054, and their heirs and rights to Real Property at 52 Naticook Rd.,
Merrimack, NH 03054.
WHEREFORE, THE PETITIONERS, KAREN J. GAGNON or KAREN GAGNON, POLICYHOLDER/HOMEOWNER AND MICHAEL J. WHEREFORE, MR. MICHAEL J. GAGNON OR MICHAEL GAGNON, HOMEOWNER AND KAREN J. GAGNON OR KAREN GAGNON IS BEING PREJUDICED WITH AN ILLEGAL MECHANICS ATTACHMENT LIEN ON 52 NATICOOK RD. MERRIMACK, NH 03054, CREDIT REPORT DEFAMATORY REMARKS, FINANCIAL AND MEDICAL DISTRESS, AND REAL AND PERSONAL PROPERTY ASSAULT DUE TO MASSIVE IDENTITY THEFT.
WHEREFORE, THE PETITIONERS PRAY:

The following documents are from various fraudulent court dockets in NH to Fraud Karen Gagnon from recieving due process and to expose the Fraudulent and Corrupt Court Proceedings in New Hampshire for all to pontificate and start to ponder why our country is in trouble. Our basic Bill of Rights are in jeopardy as the State of New Hampshire does not uphold a citizens’ right to due process and equal application of the law amongst its citizens.
Given: Dennis T. Ducharme, Esquire of Wiggin & Nourie was not retained by State Farm Mutual Automobile Insurance Company v. Karen Gagnon (the only policyholder for 52 Naticook Rd., Merrimack, NH 03054). If one reviews the State Farm Fraud list of Dennis T. Ducharme’s client list #1550 represents “State Farm Mutual Automobile Insurance Company” and Mr. Ducharme’s reference in his correspondece to all of Karen Gagnon’s attorneys and POA, Bonalyn J. Hartley and the New Hampshire Superior Court Systems is with his file #1550/62123.
So, to see the Fraud and Collusion that Attorney Dennis T. Ducharme has crafted in his Wiggin & Nourie internal files, you have to see that #1550 = State Farm Mutual Automobile Insurance Company and #62123 = re: Michael and Karen Gagnon.
Now, here is the Fraud, there is no legal entity called “Michael and Karen Gagnon”….worse Mr. Dennis T. Ducharme keys the internal Wiggin & Nourie account as “Michael Gagnon.” Now there is serious fraud here…since Karen Gagnon is the only policyholder with State Farm Mutual Automobile Insurance Company for 52 Naticook Rd., Merrimack, NH, as this is an insurance matter and Mr. Dennis T. Ducharme knows that Karen Gagnon is only policyholder. Also note that Mr. Dennis T. Ducharme never acknowledges that there is a law suit commenced in his client listings….just a item re: Michael and Karen Gagnon (again not a legal entity). Your legal name must be stated separately and in full.
When there are two or more persons on a deed of real estate property and only one is the policyholder, the only way to legally proceed with any damages is to create two separate law suits, one for the policyholder and one for the deedholders, to insure that there is no prejudicing or inducement (by action) that any one else is on the policy. Further, all writs of summons need to have your full legal name and Defendants’ legal entity names must be properly stated and served to the NH Secretary of State..which never happened.
Mr. William Aivalikles, Esquire hired by Karen Gagnon, policyholder, fraudulently put an illegal name “Michael and Karen Gagnon, individually and Parents of Adam Gagnon” on the Writ of Summons, he also did not name any of the Defendants, except “State Farm Insurance Company, et al” which is not a legal entity it is a trademark name. He also did not serve any of the required entities. Nor did William Aivalikles, Esquire have the Plaintiff, Karen Gagnon sign the Writ of Summons. The Writ of Summons was filed late and can not be a legal commencement of a lawsuit action and Judge Nicolosi knew this as the Writ of Summons was filed on October 6, 2010 or one day after the return date of October 5, 2010. Thus, given all of the above, Karen Gagnon never had due process. Her attorney, William Aivailikles, Esquire is in collusion with Dennis T. Ducharme made sure that a legal commencement would never happen.
Happy reading with these Fraudulent documents….notations of Fraud, Collusion will be made. Will the FBI finally prosecute Mr. Dennis T. Ducharme, Esquire for the Fraud that he is. He has stolen insurance proceeds funds in the amount of $67,318 and the STate of NH Insurance Department, State of New Hampshire Attorney General’s Office, nor the Governor’s office will make this Fraud pay for his crimes.
Here’s the collusion, how does Dennis T. Ducharme know the court case docket number assigned to this alleged docket? Why is this filing not on official Wiggin & Nourie Letterhead? In fact, Mr. Dennis T. Ducharme appears to be acting on his own with no involvement from Wiggin & Nourie (Law firm). This is another perfect example of the Tortious Interference that Mr. Dennis T. Ducharme and the STate of New Hampshire Superior Court System and related notified attorneys allowed this fraudulent activity to pursue.
Here’s proof that William Aivalikles, Esquire stole Karen Gagnon’s money and never served Service Master Elite, Service Master Clean, Service Master AAA, CCaps, LLC. Why was Service Master never served? To fraud karen Gagnon and hide Service Master from the NH Department Insruance Company, as Service Master was allowed to rampage the home a 52 Naticook Rd., Merrimack, NH post fire suppression…Fire Chief Michael Currier of Town of Merrimack, NH instead of securing Karen Gagnon’s home for proper investigation and identification of damage….the home was tainted by Service Master and its many men performing unlawful enviromental wastse (fire damage) without permits, contract with Karen Gagnon, policyholder and carrying wood and blowers, dehumidifiers, vapor sharks, ozone machines, etc. to try and hide the extensive damage of the home. This was to low-ball the claim when the home easily was damaged in excess of 75% of the ACV of the home, which local ordinace then requires full demolition of the home.

FRAUD AND COLLUSION AMONGST ALL ATTORNEYS, POAS, NH COURT CLERKS, NH COURT JUDICIARY, NH INSURANCE DEPARTMENT, NH ATTORNEY GENERAL OFFICE, TOWN OF MERRIMACK, NH, WELLS FARGO, AND VARIOUS MEDICAL PERSONNEL
As found out through Wells Fargo, all OF THE ABOVE ENTITIES never obtained official representation that Mr. Dennis Ducharme can speak on behalf of any State Farm entity. Wells Fargo admits and reveals the illegal discussions amongst Mr. Dennis Ducharme, Esq. and Wells Fargo and State Farm.
Read the Decmber 31, 2010 letter from Attorney Dennis Ducharme where he is admitting that there is no legal entity “State Farm Insurance Company” but yet his filings with the court and many many other fraudulent documents were filed by Mr. Dennis Ducharme, Esquire under the watch of Wiggin & Nourie and promoted to President of Wiggin & Nourie in early 2011.
Mr. Dennis Ducharme, Esquire and Mr. William Aivalikles, Equire (Karen Gagnon’s void attorney) and the Hillsborough Superior Court South, Nashua, NH are in collusion to allow Mr. Dennis Ducharme file a late Special Appearance for State Farm Fire and Casualty Company and State Farm Mutual Automobile Insurance Company (defendants), twenty days after the return day of October 5, 2010. Worse, the New Hampshire Superior Court Hillsborough South, Nashua, NH 03060 accepted this and did not file automatic judgement against all State Farm entities named in the writ of Summons for failure to appear/file on or before the return date. Worse, all Attorneys should have objected to this filing and Mr. William Aivalikles, Esquire (Karen Gagnon’s void attorney) should have Motioned the Court for Summary Judgment for Karen Gagnon against all State Farm entities named in the Writ of Summons.
When Karen Gagnon found out about the illegal Writ of Summons filed by her void attorney William Aivalikles, Karen Gagnon plead with the court on an EX-PARTE Motion to honor the default judgement against all STate Farm entities named in the Writ of Summons. Sadly and wrongly, Judge Nicolosi denied Karen Gagnon’s pleas.
Mr. Dennis Ducharme, Esquire actually signs the letter as “State Farm Insurance Company” and on many mailed letters/documents. Even if the Writ of Summons was filed correctly and even if STate FArm Mutual Automobile Insurance Company (bundled policies of auto and home insurance) was served, the proper procedure to Dismiss an entitiy is within thirty days of the return date with a Motion to Dismiss to the Court. The letter is an end-run around the judicial system as the docket is void and illegal.
Why would Mr. William Aivalikes, Esquire file a late Writ of Summons, that does not have Karen Gagnon’s name on it, as the only policyholder with State Farm Mutual Automobile Insurance Company and STate Farm Fire Casualty, not signed by Karen Gagnon? It is because he is in collusion with Mr. Dennis Ducharme who is fraudulently representing State Farm and he collected over $35,000 on an illegal blended-contingency contract knowing that Karen Gagnon is the only policyholder for 52 Naticook Rd., Merrimack, NH yet Mr. Aivalikles addes illegal names and names that should not be on the docket or documents.
Mr. Dennis Stavrou is in colllusion with Mr. Dennis Ducharme as Mr. Dennis Ducharme withheld $67K check from Karen Gagnon for over one and a half years stating that Mr. Stavrou should be paid on his illegal and void contract? This is because Mr. Dennis Stavrou, NH Public Adjuster, Property Adjsuter Associates, accepted checks for ice-blasting on disputed claims by Karen Gagnon. Even the Town of Merrrimack, NH states that the home has failed rough frame inspection three times, never mind that the Town of Merrimack, NH should have secured the home for the Building Code Officer should have condemned the home given the amount of soot, water, smoke, fire and heat damage in the home. The house should have been condemned, instead the Town of Merrimack allowed Service Master Elite unsupervised without permits and contract and appraisals to document the extensive damage.
So, Service Master Elite wants to get paid to fraudulently dry out wet soot heat and fire damaged materials in the home for over two weeks when the home should have been condemned. For the amount of money that STate Farm paid Service Master Elite and is willing to spend thousands of dollars for a Hygenist to come into the home to do multiple testings over the four seasons when it is clear that the house is a safety and health concern due to the extent of contaminated water travelling through the walls and heating system. So, the total amount to dispose and resheet rock (not inlcuding insulation) is cheaper to replace than to dry and sample for four seasons to cover up the facts that the house required demolition.
Guess what the Hygenist (“RFP Associates”) that Mr. Dennis Ducharme wanted to bring in is in conflict with the State of New Hampshire as RFP Associates, Mr. Dennis Francoeur, Principal has a long-term contract with the STate of New Hampshire to perform annuual evaluations of State Offices. Karen Gagnon, only policyholder pointed out this illegal tresspassing and conflict of interest to her then void Attorney William Aivalikles in the following emailed word document:
Oh by the way, no one did Meg testing (not State Farm, not the Town of Merrimack, NH), except for the homeowners at 52 Naticook Rd., Merrimack, NH but the Town of Merrimack, NH allowed Service Master Elite to utilize the numerous blowers, dryers, dehumidifier, vapor sharks, ozone machine, air scrubbers and to perform unlawful environmental waste demolition without permits. The homeowners at 52 Naticook Rd., Merrimack, NH whose contractor revealed that the electrical does not meet code. See below document of Service Master Elite work though they are fraudulent in that there are over two weeks of equipment, not five days. Also note that Ms. Sara Wallek is the Adjuster for State Farm Mutual Automobile Insurance Company and State Farm Fire and Casualty Company. And note that Service Master notates that they arrived on 10/24/2009 the night of the fire. How can Service Master Elite have Karen Gagnon’s claim number before she does? Why did STate FArm call them in? To low-ball the claim.
So, you attorneys probably see many things wrong with these documents but all attorneys named and the court system allowed these fraudulent documents to be filed and allowed illegal tresspassing onto the property of 52 Naticook Rd. since the Writ of Summons is void as it was filed one day after the return date. And for this to continue for over 2 and one half years is unconsciencenable and unconstitutional and beyond Attorney Ethics to illegally obtain/request interrogatories from one illegal docket to be used in other illegal dockets.

In fact, Michael Delaney, the NH Attorney General is an alumni from Wiggin & Nourie, PA and Mr. Jack Slatoff, PHD also stated that this is such a prestigous law firm that the state of NH selects judges, attorney generals/assistants, and NH insurance attorneys. Also, Wiggin & Nourie, PA is in conflict with themselves as Attorney Jason Major pursues Class Action lawsuit against Bergeron Construction Company Inc. along with Mr. Dennis Stavrou, NH Public Adjuster and Mr. Dennis Ducharme, Esquire as they illegally utilized illegal documents from the fire of 52 Naticook Rd., Merrimack, NH to pursue this illegal class action lawsuit of which 52 Naticook Rd. Merrimack, NH file loss has nothing to do with the class action nor did the homeowners know of this or willingly participated in this class action lawsuit.
According to the Union Leader Article, Wiggin & Nourie, PA is closing its doors in four months. Why four months? And, it is very clear that Wiggin & Nouri, PA must close its doors due to the fraudulent and unethical attorney behaviors.

That is why Ms. Bonalyn J .Hartley’s POA documents are not filed with proper stamps never mind her illegal collusion with the Defendants through various means for her own benefit with Pennichuck Water Works and other means.
Mr. Derek Lick, Esquire of Sulloway and Hollis, Concord, NH is in conflict with the Judicial Court Systems as he the Chairperson who is assigned from the NH Bar to work with the Court Processes in New Hampshire along with Court Clerks and Ms. Barbara Sweet. Superior Court Coordinator. Mr. Derek Lick knowingly allowed fraudulent and void dockets to be processesd with bad court stampings (void) and participated in various fraudulent filings.

How many things can you find fraudulent and unprofessional with this unlicensed EFI Global Report? Note that the report is Priveleged and Confidential to the Addressee, James Murphy…if it is such a wonderful report why is it only for James Murphy, State Farm Ins. (whatever State Farm entity that is?) Yet, the Town of Merrimack, NH Building code Enforcement has this Fraudulent Report in the Public Files for 52 Naticook Rd., Merrimack, NH. Why would the Town of Merrimack, NH ever accept a third party privileged and confidential report that is unlicensed, unsealed, unsigned and fraudulent that would never meet local town building codes? Ouch!!!!
By the way, State Farm has not provided the appraisals for the home. One has to wonder why as this is a requirement of NH Insurance RSAs to provide the policyholder with this information?
